Program Terms & Conditions
Thank you for registering your member in our Lean Programs and Events (here after “Lean Program”). Lean Sensei International (a division of iCreative Service Inc.) (“Lean Sensei”) looks forward to having your member join our Lean Programs. By registering individual(s) (“Participants”) for this program, your organization, and the individual(s) you register, are agreeing to the following terms and conditions.
GENERAL COMMENTS
Participants understand that they have a responsibility to represent the Lean Program in a professional, positive manner to all companies involved. Participants will do their best to act professionally and ethically to all members of the group and treat each other with respect.
RESERVATIONS, DEPOSIT AND FINAL PAYMENT
The full amount of the Lean program is due immediately upon confirmation of the registration. The payment must reach Lean Sensei office within two weeks of the confirmation of the Lean Program or 60 days before the start of the Lean Program, whichever is earlier. If we do not receive the Lean Program fee by this date, we are not able to guarantee your member a spot in the Lean Program. Fees are subject to HST if you are a Canadian company.
PROGRAM PACKAGE
Lean Sensei reserves the right to adjust prices without notice, should there be unexpected sudden changes or fluctuations in the Foreign Exchange Markets. Lean Sensei reserves the right to modify or adjust any part of the Lean Program when deemed necessary for the best interests of the client.
CERTIFICATION REQUIREMENT
Lean Programs are designed to provide participants with unique opportunities to grow their mind and to become a lean leader. At Lean Sensei, we believe that the investment made by the sponsoring company needs to be fruitful for both parties. Specifically, those who graduate from Greenbelt and/or Blackbelt are expected to stay in their sponsoring company for at least 12 months after the program completion. If the Greenbelt and/or Blackbelt graduates leave the sponsoring company within the 12 months of the graduation, Lean Sensei reserves the right to decertify the participant and to remove the Greenbelt and/or Blackbelt certification.
UNUSED LEAN PROGRAM
No refunds or exchanges will be made for any missed or unused Lean Program services, materials or meals. It may be possible to transfer your member’s registration to someone else in your firm should an emergency occur, but there will be a change fee (see below for details).
NAME OR PARTICIPANT CHANGE
If for some reason, the original member cannot attend the Lean Program and the participant’s name needs to be changed or substituted, the following change fee would apply. Please note that each time a person changes a name or substitutes a name, Lean Sensei has to re-issue the class list to companies affected, causing possible delays.

30 or more: none (no charge for the name change as long as it is not a cancellation and there are no changes required for hotels, food/allergy/diet etc.)
15 to 29: 10% of the program cost per change per person
0 to 14 (i.e. two weeks prior to the event): no name change allowed. If a change is required it will be treated as a cancellation with full penalty (100% of the program cost)
CANCELLATION POLICY
Our Program has the following cancellation policy:

TRANSFER FEE
It may be possible to transfer your member’s registration to the next Lean program should any medical emergency occur and you are suddenly not able to attend. Please contact us as soon as you become aware of a need to transfer a registration. There will be a transfer fee of 50% of the program cost if the transfer request is made to another future program within 30 days of the event (ie. you may only carry half of the credit towards the next program). You will be required to produce a proof of emergency (for example, a doctor’s note).
CONFIDENTIALITY
Only Lean Program participants are permitted to use the training/reference materials provided to them during the program within their own company. Lean Program participants will be exposed to confidential information pertaining to the services provided by Lean Sensei and the work processes of other companies represented in the program. Lean Program participants agree to hold in confidence all such confidential information.
NON-COMPETITION
Lean Program participants, and the organizations registering them, shall not, during the Lean Program or within twelve (12) months following the cessation of the Lean Program, engage in or be employed by or have any financial interest in or lend any assistance to any business that competes with the Lean Sensei’s core business of lean consulting.
More specifically, Lean Program participants may not assist Lean Sensei’s competitors in setting up a similar program to Lean Sensei’s Lean Programs, or provide key Lean Program information to Lean Sensei’s competitors.
Lean Program materials are provided for participants to use them as training and implementation tools. The materials cannot be sold in any fashion to another company or individual. The Lean Program materials can be used for training and implementation purposes at the participant’s sponsoring company (employer). The materials cannot be used to train other, outside companies or individuals that do not belong to the participant’s employer.
NON-SOLICITATION/HIRING/RECRUITING OF EMPLOYEES AND CONTRACTORS
Lean Program participants, and the organizations registering them, shall not, during the Lean Program or within twelve (12) months following the cessation of the Lean Program, directly or indirectly recruit, hire, employ, contract, receive work from, engage, solicit or endeavour to entice away from Lean Sensei any individual who is an employee or contractor of Lean Sensei or service provider to Lean Sensei, or was an employee or contractor of Lean Sensei or service provider to Lean Sensei in the previous twelve (12) months for the purpose of giving that employee, contractor or service provider work in the nature of which Lean Sensei performs.
LIMITATION OF LIABILITY
Lean Sensei shall not be liable for any injuries, damages or losses of any kind incurred because of changes made to work processes arising out of the Lean Program. Any such changes are the sole responsibility of the organization hosting and/or registering the Lean Programs. Lean Program participants, and the organizations registering or hosting them, have the responsibility of making the final decisions around the implementations of any lean suggestions or ideas.
As an organization registering one or more individuals for the Lean Program, you agree to indemnify and hold Lean Sensei harmless from and against all liabilities, costs, charges and expenses (including legal fees and disbursements) reasonably incurred by Lean Sensei in respect of any third party action or proceeding to which your organization may be a party and which is related to or in any way associated with the Lean Program, except as those liabilities, costs, charges and expenses relate to negligent or wrongful acts or omissions of Lean Sensei.
Participants further understand that during this Lean Program, participants may have the opportunity to participate in various activities on a volunteer-basis, any of which could carry risk beyond the control of Lean Sensei. Therefore participants understand that they are under no obligation to participate in any events and, if they do decide to participate, such a decision is theirs alone and Lean Sensei will not be liable for any injury, loss, damage, expense, delay or inconvenience arising out of such participation.
FOOD ALLERGIES
Participants are aware that one of the risks inherent in general involvement with the Lean Program is exposure to outside foods and food preparation methods that may result in food allergies or other allergies.
Participants therefore waive any and all claims that they have or may in the future have against Lean Sensei, and release from all liability Lean Sensei, and its shareholders, directors, officers, employees, servants, agents and representatives (collectively, the “Personnel”) for any damages or loss due to any food or other allergies which participants may be exposed to during the Lean Program. MATERIAL OWNERSHIP
Participants may be given materials related to the programs, in either electronic format or hard copy. The program materials are given to the participants for reference use. They may use the materials for internal training or projects within the company they are employed with. The materials shall not be given or sold to others who did not take the program. The materials are for sole use by the program participants who have received specific training on the materials.
